Terms of Service
Last updated: 22 October 2026
These terms govern your use of brightreach.co.in and the BrightReach customer follow-up platform (Andhra Pradesh, India).
1. The Service & Eligibility
BrightReach is a business-to-business (B2B) software-as-a-service application designed for verified appointment-based service providers (including clinics, salons, automotive service centers, and professional consultancies). By registering for an account or waitlist, you warrant that you are acting on behalf of a legitimate commercial enterprise.
2. Merchant Anti-Spam Obligations & Data Warranties
BrightReach enforces strict compliance with global email standards and the AWS Acceptable Use Policy. As a merchant utilizing our platform, you unconditionally warrant and agree that:
- Direct Customer Relationship: You will only enter or sync email addresses of customers who have directly booked an appointment, purchased a service, or affirmatively requested notifications from your business.
- Prohibition on Third-Party Lists: You will NEVER upload, import, or dispatch messages to purchased, rented, scraped, traded, or third-party lead databases.
- Consent Records: You must maintain verifiable evidence that recipient consent was collected prior to scheduling promotional review requests or service recalls.
- Honor Unsubscribes: You will not attempt to bypass our automated suppression lists or manually re-subscribe clients who have opted out.
3. Delivery Hygiene & Account Suspension
To protect shared IP reputation and recipient mailboxes, BrightReach monitors delivery metrics continuously:
- Any merchant tenant generating a hard bounce rate exceeding 4.0% or a spam complaint rate exceeding 0.1% will have their automated dispatches paused immediately pending manual review.
- Deliberate attempts to send spam, affiliate marketing, or unverified cold bulk correspondence will result in permanent account termination with zero refund.
4. Service Availability & Disclaimers
BrightReach employs redundant cloud infrastructure with target 99.9% uptime. However, third-party mailbox providers (such as Google, Microsoft, and Yahoo) retain ultimate discretion over recipient inbox placement. The service is provided “as is” without warranties of specific revenue outcomes.
5. Limitation of Liability
To the maximum extent permitted by Indian law, BrightReach and its operators shall not be liable for indirect, incidental, or consequential damages arising from service interruptions or third-party email provider filtering.
6. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the competent courts at the operator's registered domicile.
